Examples include the use of AI in credit scoring, hiring processes, predictive policing, or facial recognition in public spaces.

Without comprehensive and harmonized regulation, there's a risk of a "race to the bottom" where the pursuit of innovation overshadows citizen protection, or conversely, regulatory fragmentation that hinders responsible AI development and adoption. There is an urgent need to balance fostering technological innovation with mitigating risks, ensuring that AI is developed and used in an ethical, transparent, and human-centric manner.

The European Union's AI Act, a pioneering piece of legislation, seeks to answer this critical public challenge: How can legislation ensure that Artificial Intelligence systems are safe, respect fundamental rights, and foster responsible innovation, by establishing a clear framework for their development, commercialization, and use within a risk-based approach?

Crafting the Rules: The EU's Legislative Journey for AI

The development and approval of the European Union's Artificial Intelligence Act is not a scientific investigation in the traditional sense, but rather a complex legislative and public policy-making process. This multi-year endeavor involved numerous stakeholders:

  • Proposal from the European Commission: The journey began with a proposal from the European Commission in April 2021. This was built upon extensive preparatory work, including public consultations, impact assessments, and expert studies on AI's risks and opportunities.
  • Co-decision Procedure: The proposal then entered a "co-decision" procedure where the European Parliament (representing EU citizens) and the Council of the European Union (representing the governments of the 27 Member States) debated, amended, and negotiated the text.

      • Migration, asylum, and border control management.
      • Medical devices and product safety systems.
      These high-risk systems must meet rigorous requirements: risk management, data quality, activity logging, detailed documentation, human oversight, and high robustness, accuracy, and cybersecurity.
    • Limited Risk (Transparency Requirements): AI systems that interact directly with people and must be transparent. Examples include chatbots or systems generating deepfakes (synthetic content). Users must be informed that they are interacting with AI, and artificially generated content must be clearly identifiable.
    • Minimal or No Risk: The vast majority of AI systems fall into this category and are not subject to additional requirements.
  • Exceptions for Law Enforcement: The use of "real-time" remote biometric identification systems by law enforcement is prohibited *a priori*, except in exceptional and very strict situations (e.g., searching for missing persons, preventing terrorist attacks), which require prior judicial authorization. "Post-use" (offline) identification is considered high-risk and also requires judicial authorization.
  • Requirements for Generative AI (GPAI): Models like ChatGPT must comply with transparency requirements, including disclosing that content was AI-generated, designing the model to prevent illegal content generation, and publishing summaries of copyrighted data used for training.
  • Citizens' Rights: Citizens will have the right to file complaints about AI systems and to receive explanations for decisions made by high-risk AI.
  • Fostering Innovation: The law also seeks to support AI innovation in Europe by establishing "regulatory sandboxes" where companies, including SMEs, can develop and test AI systems in a controlled environment.

The theoretical or conceptual implications of this law are that the European Union is setting a precedent for AI governance at a global level, based on a human-centric and rights-based approach. This elevates the discussion about AI from a purely technological realm to one of public policy and ethics. Far-Reaching Impact: Shaping the Future of AI

The EU Artificial Intelligence Act will have a practical and far-reaching impact on multiple levels, from technological innovation to the daily lives of citizens.

Regarding applications in public policy:

  1. Setting a Global Standard: The law positions the EU as a global leader in AI regulation, with the potential to influence the regulations of other countries and regions, similar to the impact of the General Data Protection Regulation (GDPR).
  2. Legal Certainty for Businesses: While the regulation imposes obligations, it also provides a clear and predictable framework, which can encourage investment and the responsible development of AI by reducing legal uncertainty.
  3. Citizen Protection: The law grants citizens specific rights and complaint mechanisms, strengthening data protection, privacy, and other fundamental rights in the AI era.
  4. Cohesion in the Single Market: By establishing uniform standards, the law facilitates the commercialization of AI systems across the EU, preventing regulatory fragmentation among Member States.
